In order for a summons for a NOISE COMPLAINT to be processed, it is necessary for two (2) complainants (not from the same household) to supply specific facts concerning the incident or situation. A brief written statement of what both complainants heard or saw will be comprised in the description, including specific dates and times the incident occurred. This information will be converted into an accusatory instrument, which is required to be signed before a Notary Public.
The summons will be personally served on the defendant who must then appear in Court. If the defendant pleads “guilty”, the Court will set a fine. However, if the defendant pleads “not guilty”, a date will be set for trial. At that time both complainants will be notified to appear in Court on a specific date and time to give testimony concerning the incident.
